DeskAgency provides AI phone receptionist services that answer calls, book appointments, capture leads, and provide call summaries for local businesses. The specific scope, features, and configuration of the service are set out in the agreement between DeskAgency and each client.
Free Trial
We may offer a free trial period for new clients. Details of any trial, including its length and what it includes, will be communicated at the time of sign-up. We reserve the right to modify or discontinue trial offers at any time.
Fees and Payment
Fees for our services are described at the time you sign up or as set out in your service agreement. Unless otherwise stated, fees are billed on a recurring monthly basis. You are responsible for all applicable taxes. We may change our fees with reasonable notice.
Client Responsibilities
If you use our services for your business, you agree to:
- Provide accurate information needed to set up and operate your AI receptionist;
- Use the service in compliance with all applicable laws, including those governing call recording, telemarketing, and consumer protection;
- Obtain any consents required from your own customers or callers; and
- Not use the service for any unlawful, harmful, or abusive purpose.
Acceptable Use
You agree not to misuse our website or services, including by attempting to disrupt the service, reverse engineer it, access it without authorization, or use it to transmit unlawful, fraudulent, or harmful content.
Third-Party Services
Our services rely on third-party platforms (such as telephony, artificial intelligence, scheduling, and hosting providers). We are not responsible for the availability, performance, or actions of these third parties, though we work to select reliable providers.
Service Availability
We strive to provide reliable service but do not guarantee that the service will be uninterrupted or error-free. Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will meet all of your requirements or be error-free.
Limitation of Liability
To the fullest extent permitted by law, DeskAgency will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of our services. Our total liability for any claim will not exceed the amount you paid us for the service in the three months preceding the claim.
Termination
Either party may terminate the service in accordance with the applicable service agreement. We may suspend or terminate access to our services if you violate these Terms or use the service in a way that could harm DeskAgency, other users, or third parties.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.
